1. Acceptance of Terms

By accessing or using DigiEvents, you agree to be bound by these Terms of Service, our Privacy Policy, and any additional terms applicable to specific features. If you do not agree, you must not use the Platform.

2. Description of Service

DigiEvents is a cloud-based software platform providing AI-powered wedding and event planning tools including guest management, RSVP automation through WhatsApp Business API, seating management, vendor coordination, budget tracking, event timelines, AI assistant features, and AI-powered venue visualisation.

3. Eligibility and Account Registration

• You must be at least 18 years of age to create an account.
• You must provide accurate, complete, and current information during registration.
• You are responsible for maintaining the confidentiality of your credentials.
• You must notify us immediately of unauthorised access to your account.
• One person or legal entity may not maintain more than one account without prior written approval.

4. Planner Responsibilities

• You have obtained necessary consents from wedding guests before storing their data or sending WhatsApp messages.
• All guest, vendor, and event information entered into the Platform is accurate and lawfully obtained.
• You will use the Platform only for legitimate wedding and event planning purposes and in compliance with law.
• You will comply with Meta's WhatsApp Business API Terms and Policies.
• You acknowledge that you act as Data Controller for guest personal data and Digiflyer acts as Data Processor on your behalf.

5. Acceptable Use Policy

You agree not to use DigiEvents to send spam, process unlawfully obtained personal data, impersonate others, upload malicious code, gain unauthorised access, commit fraud, reverse engineer the Platform, resell the Platform without permission, or violate applicable law.

6. WhatsApp Business API — Specific Terms

• Message templates must be submitted and approved by Meta before use.
• Messages may only be used for legitimate wedding-event purposes such as invitations, RSVPs, reminders, and related transactional communications.
• You are responsible for valid guest numbers and guest consent.
• We may suspend WhatsApp integration without notice if Meta flags your account for policy violations.
• Marketing messages unrelated to a specific wedding event are prohibited.

7. AI Features — Disclaimer

• AI-generated responses, updates, and visualisations may contain errors and should be reviewed before reliance.
• Venue visualisations are artistic representations only and are not guarantees of final decor outcomes.
• You are responsible for reviewing AI-generated data changes inside the Platform.
• AI outputs do not constitute legal, financial, or professional advice.

8. Subscription and Payment

• DigiEvents offers per-wedding and subscription plans as published on the website.
• Payments are processed through authorised payment gateways such as Razorpay or equivalent providers.
• Per-wedding plans are refundable up to 2 business days before the event date. Monthly subscriptions are non-refundable for the current billing period.
• Accounts may be suspended if payment fails and remains unresolved.

9. Intellectual Property

DigiEvents, its branding, software, AI models, and associated intellectual property are owned by Digiflyer Advertisement Services Private Limited. You receive a limited, non-exclusive, non-transferable licence to use the Platform during your subscription.

You retain ownership of data you upload and grant us a limited licence to process that data for service delivery. AI-generated outputs are licensed to you for personal and professional wedding planning use, and may not be resold without written permission.

10. Limitation of Liability

To the maximum extent permitted by law, Digiflyer is not liable for indirect, incidental, special, consequential, or punitive damages arising from use of DigiEvents. Our total liability will not exceed the amount paid by you in the 3 months preceding the claim.

We are not liable for disruption in WhatsApp, Meta, or other third-party services, or for damages resulting from AI inaccuracies, visualisation errors, or incorrect AI-updated data.

11. Disclaimers

DigiEvents is provided "AS IS" and "AS AVAILABLE" without warranties of any kind. We do not warrant uninterrupted availability, error-free operation, or complete security, and disclaim implied warranties to the extent permitted by law.

12. Termination

You may terminate your account at any time by contacting us. We may suspend or terminate accounts immediately for violation of these Terms, abuse of the Platform, non-payment, or harmful activity. Upon termination, your licence ends immediately and you may request a data export within 30 days.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts of Indore, Madhya Pradesh, India. We encourage good-faith negotiation before formal proceedings.

14. Changes to Terms

We may update these Terms with 30 days notice to registered users. Material changes will be communicated by email. Continued use of DigiEvents after the effective date constitutes acceptance of the updated Terms.
